      ​Several Friends of Unfair Park -- which is to say, the handful of people still listening to 93.3 Quality Rock -- have e-mailed me this morning wondering what the what is going on on the left side of the FM dial. Because starting at midnight, the fledgling station began broadcasting a schizophrenic hodgepodge of format promos -- everything from old-school country to classic rock to jazz -- and the Web site now says it's "under construction."Of course, it was just four months ago that Cumulus Media Inc. buried The Bone and went for the Snow Patrol-Coldplay crowd; said Jeff Catlin, operations manager for Cumulus Radio Dallas, at the time, "I think the station has a real chance to succeed." But the format, or lack of one, never caught on: It sat near the bottom of the ratings since its launch, especially with the coveted 25-54 demographic. So, that's that.What's the new format? Hard to say. Catlin's been unreachable this morning, but Unfair Park has learned that the latest extreme makeover is being handled by Cumulus execs who came to town from Atlanta this week and set the station to "stunt" in advance of the changeover. Messages have been left for John Dickey, the chain's executive vice president and co-chief operating officer, and Jan Jeffries, the senior veep in charge of programming.

For years, it belonged to the Hunt family, which wasn't in a hurry to develop the property; instead, H.L.'s heirs worked with Dallas, Richardson and DART to clear the way for the rail line and attendant station.But the Hunt trust has done sold the land, and its new owners, Lovers Lane-based Parliament Group Inc., tell GlobeSt.com they're gonna take their time to study what's what: "Right now we have a blank canvas out there," says one partner in the group, which builds planned communities and operates warehouses, "and the worst thing we
could do is pull the trigger on something that doesn't belong there."

      ​Says this sneak preview of the city council's Economic Development Committee agenda next week, Dallas is considering forking over an economic development grant to Hilton Hotels, which is looking to relocate a regional headquarters to Dallas. Office of Economic Development head Karl Zavitkovsky, as always, has at least some insight into the deal."They're looking at moving some facilities from Farmers Branch to a location in Dallas," he says, adding that he's unclear which facilities are being discussed here. He recommended we talk to Hammond Perot, the assistant director at Economic Development; he wasn't in when we called earlier."We didn't go out and actively raid Farmers Branch," Zavitkovsky says. "They came to us with a site, and as far as we're concerned it adds a couple hundred jobs and taxable property."

 When asked when Hilton's looking to make the move, he says, "It's in the next couple of months."

      ​Nobody gives a speech like Federal Reserve Bank of Dallas president and CEO Richard Fisher. He quotes Bob Dylan. He likens the economy to a Rube Goldberg contraption, which he proceeds to render in extreme detail. And, yesterday, during a speech given to the Laboratory for Aggregate Economics and Finance at the University of California-Santa Barbara, Fisher managed to work in ... Dolly Parton's breasts. As in:As Professor Rupert mentioned, my wife Nancy and I are bibliophiles. We collect rare books. This is an expensive hobby that began when I wrote a paper as a student at Stanford's Graduate School of Business on the imperfect auction market for out-of-print first editions. As you might guess, the recent financial crisis has ratified much of what I wrote about over 30 years ago, and that, as Peter mentioned, is what enabled my recent bargain-priced purchase of the original Oxford English Dictionary and a near-mint-condition 1841 printing of Mackay's Memoirs of Extraordinary Popular Delusions, a book I recommend to anybody who wants to understand the pathology behind the recent -- and any other -- financial crisis.Our interest in books led us to serve on a committee that advises the Library of Congress. It was through the library that we were introduced to the country singer Dolly Parton. Most people think of Dolly as the caricature of Marx's -- Groucho's, not Karl's -- swarmy quip: "She has eyes that folks adore so, and a torso even more so." But Ms. Parton has a prodigious brain for music and business -- and a passion for books. She has done a great deal for education -- her foundation now gives out, free of charge, over 6 million books a year to pre-K children in more than 40 states, the District of Columbia, Canada and the United Kingdom to start them on the road to reading.What does this have to do with the economy? Well, in thinking about what I wanted to say tonight, I was reminded about an incident that occurred when Ms. Parton was given the Library of Congress' Living Legend medal for her contributions to American culture. At dinner afterward, a rather indignant woman, offended by Ms. Parton's ... topography, thought to diminish her by noting how disproportionately small her feet seemed to be. Dolly's saucy riposte was a classic: "Well, you know, sweetie, it is very hard to grow anything in the shade."Tonight, I wish to speak of the difficulty of growing our economy in the shade of an abundance of excess capacity for the production of goods and services worldwide.He follows that with more pop-culture references -- oh, and his economic forecast, which is partly sunny with a chance of afternoon shitstorms:  "We are likely to see a prolonged period of sluggish economic performance and uncomfortably high unemployment as businesses reallocate capital and labor to fit the new economic landscape."

      The Chili's in the American Airlines Center, gone as of early this morning​As of today, the Chili's in the American Airlines Center is no more. And, yes, you'll say, But of course, just like all the other restaurants that have shuttered in Victory Plaza. Only, this tale is a bit more complicated: The doors closed one last time just last night, but long before that lawsuits were filed, as was a Chapter 11 bankruptcy. The timing is ironic, to say the least: It was almost one year ago to the day that the AAC trumpted the eatery's arrival via the pages of The Dallas Morning News, whose Karen Robinson-Jacobs wrote that a Chili's down there would give "sports fans, concertgoers and downtown Dallas residents a wallet-friendly dining option in the Victory Park area."It was supposed to open in October of last year. It finally got going in December. And now, it's gone.Says attorney Richard Pullman, who's representing franchisee Gilbert Aranza, "it's a sad story" that pits his client against Center Operating Company, the operating company for the American Airlines Center. COC's attorney, Joseph Friedman, says only, "I'm not at liberty to comment" because of the pile of pending litigation. Indeed, COC has already filed suit twice against Aranza's Base Holdings -- in Dallas County District Court and in Dallas County Justice of the Peace Court. Which is why, on July 6, Aranza filed for Chapter 11: According to the initial petition, it was "necessary to ensure that the Debtor's landlord would not attempt to terminate the Debtor's lease."We'll have more on Tuesday, after we get a look at all the court documents -- so far, all we've seen are the Chapter 11 docs, including today's filings in which Center Operating Company makes it very clear it had no idea Base was moving out last night. (As in: "Late yesterday evening, September 3, 2009, the Debtor commenced a 'midnight' move out of the Chili's Restaurant located at American Airlines Center. Tables, chairs and other furniture and equipment were removed from the restaurant premises.") But this much is clear: The litigation over the AAC Chili's will last longer than the eatery did.

      ​As it turns out, the very day we were wondering what it would cost to move a Hilton Hotels regional HQ to Dallas from Farmers Branch, assistant city manager A.C. Gonzalez was sending that very info to the city council's Economic Development Committee. Here's the full memo -- and, sorry, but no, Hilton isn't moving its regional HQ to downtown after all, but a generic office building at Dallas North Parkway and Keller Springs Road.Nonetheless, the city figures it's quite the good deal: Hilton's asking for $150,000 in moving expenses (or, more specifically, an econonic development grant), which it would get only after dropping "approximately $3,000,000 in tenant improvements and approximately $1,100,000 in business personal property." And, Hilton wouldn't be eligible for the dough till it created "a minimum of 200 jobs" by no later than April 30 of next year. The only hitch: That's 50 jobs below the Public Private Partnership Program limits set by council in April 2008, which puts the minimum at 250. It's on the council's agenda for September 23.

      ​Have yet to make it to Dallas County District Court to read the lawsuits pitting Gilbert Aranza, the franchisee operating as Base Holdings who opened and rather suddenly shuttered the Chili's in the American Airlines Center, against Center Operating Company, which runs the arena. But I did spend a little more time this morning sifting through some of the docs filed in bankruptcy court, including Base Holding's initial filing for Chapter 11 in July and Center Operating Company's response filed a month later. Also among the notable filings: a 26-page missive from Center Operating Company's attorneys to Base Holdings, in which they outline the amount of rent Base Holdings allegedly failed to pay Center Operating (about $158,000) between last October and this May, as well as money owed other contractors and product providers. As it turned out, the AAC was looking to kick out Aranza long before he packed up in the middle of the night last Thursday.As usual, all the docs are available after the jump for those who can't understand how a Chili's in the AAC could go buns-up right before the Dallas Mavericks and Dallas Stars start their seasons and the DART Green Line begins service to Victory Park. But Aranza's attorney, Richard Pullman, told Unfair Park Friday evening that this whole mess was Center Operating Company's fault. He claimed that during various events, AAC officials would "barricade the doors to the restaurant" without explanation; he also said Aranza "could never get [a] parking permit for us to use the parking lot on non-event nights," referring to the lot adjacent to Victory Park."And then, during the circus, we were giving out coupons for people to come to our restaurant," Pullman said. "We said if you buy a meal, your kid gets a free one. And [Center Operating Company] said, 'You can't give out the coupons in the arena, because we have a deal with the circus operator, which gets a percentage of revenue from the concessions, which is contrary to our lease. ... We invested $2.8 million into this restaurant, because you have to spend a whole bunch of money to build a Chili's in a place where everybody has to eat in 30 minutes. The short story is, I've practiced law for 38 years in Dallas, and represented landlords for 30 of them, and never seen a landlord act like this. Never."

But according to a press release we received this afternoon, Joe Harberg's done pulled the plug on "the world's first energy efficiency store™" and moved some of the energy-efficient product to Lakewood -- the Green Living store on Abrams Parkway, to be specific, where they peddle "earth friendly goods for the home."The press release was long but not really heavy on details, save for a mention of a "strategic alliance" between the two outlets. Harberg, who founded the joint in '05 with his brother-in-law, wasn't available to talk -- in meetings, so we're told. Green Energy's CEO Tom Bazzone, who came from Restoration Hardware and bought the business a year ago, tells Unfair Park that he and Harberg have been talking about the consolidation for about a year; today's announcement is the culmination of their chats."We try to make available products for people who want to live a sustainable lifestyle, and one of the areas where we haven't done a great job is energy conservation," Bazzone says. Truth is, he's going to have to find shelf space, and the Lakewood store isn't huge; hence, his plans for a 3,000- to 4,000-square foot "prototype" down the road. "We've put the product in the store where we have room," he says. "In the
future we'll put it in more deliberately and make it more of a
destination for energy-efficient products."Of course, it wasn't so long ago that Harberg was talking about franchising Current Energy nationwide. In fact, back in February 2008 Time magazine was amped up about Harberg's energy-efficient business, not to mention the "zeal" with which he spread the green gospel. Said Harberg to Time, "You're saving people money and saving the earth at the same time." Concluded writer Bryan Walah, "As business plans go, that's an awfully good one."

      ​Even if you've never heard of the Fan Cost Index, the name is pretty self-explanatory: It's what a family of four could expect to spend at a sporting event, simple as that. Factored into the costs, per Team Marketing Index's arguable equation: the price of two adult average price tickets, two child average price tickets, four small sodas, two small beers, two programs, parking and two adult-size caps. The ball-cap buy seems like an unnecessary add-on; then again, only two beers ... and smalls? So maybe it evens out in the end.This season, the Texas Rangers' FCI is $150.64 -- far less than the Major League Baseball average of $196.89. Last season, the Dallas Mavericks' FCI came in at $344.86 -- or $52.93 above the National Basketball Association average. (But his season, yet again, the Mavs are offering some 500 $2 tickets for most home game.) And, last season, the Dallas Stars' FCI of $244.18 was well below the National Hockey League average of $288.23, though who knows what happens with dynamic pricing!All of which is a long, throat-clearing warm-up to today's news: Your Dallas Cowboys are now the most expensive ducat in the National Football League, and with an average ticket price of $159.65, well, that brings the FCI out at Jerry Jones's EnormoDome up to $758.58 -- which, if I read my numbers correctly, is a 78 percent increase over the numbers for the final season in Texas Stadium. (And, yes, that number does take into consideration the $29 standing-room-only party passes and the sold-out $59 offerings.) By comparison, the New England Patriots come in second with an FCI of $597.25. And the NFL average? $412.64. So, Richie Whitt, is it really worth it?
